1. Terms of Service & Purchase

These Terms of Purchase ("Terms") govern the purchase of original artwork from Lesley’s Artworks ("we," "us," or "our"). By placing an order through our website, you agree to these Terms.
1. Products
We sell original, one-of-a-kind paintings created by Lesley Webster. Due to the handmade nature of original artwork:
- Each painting is unique.
- Colors and appearance may vary slightly from how they appear on your screen.
- Measurements provided are approximate.
2. Pricing and Payment
- All prices are listed in Australian dollars (AUD)
- Applicable taxes, duties, shipping charges, and fees will be displayed at checkout where applicable.
- Payment must be received in full before an order is processed and shipped.
- We reserve the right to correct pricing errors and cancel orders affected by such errors, with a full refund provided if payment has already been made.
3. Order Acceptance
Your order constitutes an offer to purchase. We reserve the right to accept or reject any order for any lawful reason.
If we cannot fulfill your order, we will notify you and provide a refund of any amounts paid.
4. Shipping and Delivery
- We will make reasonable efforts to ship orders within the estimated timeframe stated on our website.
- Delivery dates are estimates only and are not guaranteed.
- We use Australia Post or Pack & Send
- Risk of loss and title to the artwork pass to you upon delivery to the shipping address provided in your order.
- You are responsible for providing accurate shipping information.
5. Inspection Upon Delivery
Please inspect your artwork promptly upon receipt.
If your artwork arrives damaged, you must notify us within [7] days of delivery and provide photographs of:
- The artwork;
- The packaging; and
- Any visible damage.
We may require additional information to process a damage claim.
6. Returns and Refunds
Because each painting is an original artwork, all sales are final unless:
- The artwork arrives damaged;
- The wrong artwork is delivered; or
- A refund is otherwise required by applicable law.
Approved refunds will be issued to the original payment method.
Nothing in these Terms limits any consumer rights that cannot legally be excluded under applicable law.
7. Intellectual Property
The purchase of an original painting transfers ownership of the physical artwork only.
Unless expressly agreed in writing:
- We retain all copyright and intellectual property rights in the artwork.
- You may not reproduce, distribute, sell reproductions of, or commercially exploit the artwork without our prior written permission.
- We may use images of the artwork for portfolio, promotional, archival, and marketing purposes.
8. Custom or Commissioned Artwork
For commissioned works:
- A separate written agreement may apply.
- Deposits are non-refundable unless otherwise agreed in writing.
- Minor variations from sketches, mockups, or concepts may occur as part of the artistic process.
If a separate commission agreement conflicts with these Terms, the commission agreement will prevail.
9. Limitation of Liability
To the maximum extent permitted by law:
- Our liability is limited to the amount paid for the artwork.
- We are not liable for indirect, incidental, special, or consequential damages arising from your purchase or use of the artwork.
Nothing in these Terms excludes liability that cannot be excluded under applicable law.
10. Force Majeure
We are not responsible for delays or failure to perform caused by events beyond our reasonable control, including natural disasters, transportation disruptions, labor disputes, or government actions.
11. Governing Law
These Terms are governed by the laws of Australia, without regard to conflict of law principles.
Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts located in Victoria, unless applicable consumer protection laws provide otherwise.
