Copyright and Licensing Policy

This Copyright and Licensing Policy explains the intellectual property rights associated with artworks purchased from Lesley Webster, owner of Lesleys Artworks (lesleys-artworks.com)

1. Ownership of Physical Artwork

When you purchase an original artwork, you acquire ownership of the physical artwork only.

Unless otherwise agreed in writing, all copyright and intellectual property rights in the artwork remain the property of the artist.

2. Copyright Remains with the Artist

The artist retains all rights under the Copyright Act 1968 (Cth), including the exclusive rights to:

• reproduce the artwork;
• publish the artwork;
• communicate the artwork to the public;
• create derivative works based on the artwork;
• licence the artwork to others; and
• authorise third parties to use the artwork.

The purchase of an artwork does not transfer any copyright, trademark, moral rights or other intellectual property rights.

3. Personal Use

The owner of a purchased artwork may:

• display the artwork in their home, office or private premises;
• resell the original artwork;
• photograph the artwork for personal, non-commercial purposes; and
• share images of the artwork on personal social media accounts, provided appropriate credit is given to the artist where reasonably practicable.

4. Prohibited Uses

Without the artist's prior written permission, you must not:

• reproduce the artwork in any form;
• create prints, posters, cards, merchandise or products featuring the artwork;
• use the artwork in advertising or marketing materials;
• use the artwork for commercial purposes;
• create derivative works based on the artwork;
• digitise the artwork for commercial distribution;
• mint, sell or distribute NFTs or similar digital assets based on the artwork; or
• authorise another person or business to undertake any of the above activities.

5. Commercial Licensing

Commercial use of any artwork requires a separate written licence agreement.

Licences may be available for purposes including:

• publishing;
• advertising;
• branding;
• packaging;
• merchandise;
• editorial use; and
• digital media.

Licence fees, scope, duration, territory and permitted uses will be agreed separately in writing.

6. Commissions and Custom Artwork

Unless otherwise agreed in writing, copyright in commissioned artworks remains with the artist.

The client receives ownership of the physical artwork and a non-exclusive licence to display it for personal purposes only.

Any transfer of copyright must be expressly agreed in writing and signed by both parties.

7. Artist Portfolio Rights

The artist reserves the right to:

• photograph completed artworks;
• display images of artworks on websites, social media platforms, portfolios and promotional materials;
• enter artworks into exhibitions, competitions and publications; and
• use images of commissioned works for self-promotion unless otherwise agreed in writing.

8. Moral Rights

Nothing in this Policy is intended to limit the artist's moral rights under Australian law.

The artist retains the right to:

• be attributed as the creator of the artwork; and
• object to derogatory treatment or modification of the artwork where permitted by law.

9. Requests for Permission

If you wish to reproduce, publish, licence or otherwise use an artwork beyond personal display, please contact us:

• the artwork title;
• the intended use;

10. Breach of This Policy

Unauthorised reproduction or commercial use of artwork may constitute copyright infringement and may result in legal action.

We reserve all rights available under applicable intellectual property laws.
